These Terms and Conditions set out the basis on which South Wales Auto Tech Ltd (“we”, “us” or “our”) provides its services to you. Please read them carefully before booking. By asking us to carry out work, you agree to these terms.
1. About us
South Wales Auto Tech Ltd is a company registered in England and Wales under company number 17252800, with its registered office at 65 Badgers Mead, Brackla, Bridgend, CF31 2PZ. We provide mobile ECU remapping, tuning and diagnostics, auto locksmith services and related vehicle solutions across Bridgend, Cardiff, Swansea and the M4 corridor. 2. These terms
These terms apply to all quotations, bookings and work we carry out, unless we agree otherwise in writing. If any part of these terms is found to be unenforceable, the remaining terms will continue to apply. Nothing in these terms affects your statutory rights as a consumer.
3. Our services
We offer a range of vehicle software, diagnostic and auto locksmith services. These may include performance and economy remapping, diagnostics and fault-code work and other ECU-related solutions, together with auto locksmith services such as replacement and spare keys, key and transponder programming, immobiliser and key-related work, and vehicle entry where you are locked out. The specific work to be carried out will be agreed with you before we begin, and all work is carried out with reasonable care and skill.
4. Quotations and bookings
Any quotation we give is based on the information you provide and may be subject to change once we have inspected your vehicle. A booking is confirmed once we have agreed a date and, where required, received any deposit. You are responsible for ensuring that your vehicle and its location are safe and accessible for mobile work.
5. Prices and payment
The price for the work will be as quoted or agreed with you. Unless stated otherwise, payment is due in full on completion of the work by the method we have agreed. Where applicable, prices are inclusive of VAT. We reserve the right to charge for additional work that becomes necessary, which we will discuss with you before proceeding.
6. Deposits, cancellations and your right to cancel
Where a deposit is required, it secures your booking and is non-refundable. Deposits are taken to cover the labour and material costs we incur in preparing for your booking before we attend — for example preparing bespoke files for your vehicle, and sourcing any parts, keys or key blanks. If you are a consumer and you booked away from our premises or at a distance, you have a legal right to cancel within 14 days; however, if you ask us to begin the work during that period and the work is then completed, you lose the right to cancel, and if you cancel part-way through you may be required to pay for the work already carried out. Because our preparation and material costs are incurred before the appointment, the deposit reflects those costs and is not refunded. If you need to rearrange or cancel a booking, please give us as much notice as possible. Nothing in this section affects your statutory rights.
7. Your vehicle and your responsibilities
Before we carry out any work, you confirm that:
- you are the owner of the vehicle or are authorised by the owner to instruct the work;
- the vehicle is in a roadworthy and mechanically sound condition, suitable for the work requested; and
- you have told us about any known faults, warning lights, previous remaps or existing modifications.
We may decline to carry out, or may recommend against, work on a vehicle that we consider is not in a suitable condition.
For auto locksmith services — such as cutting or programming keys or gaining entry to a vehicle — we will ask you to provide proof that you own the vehicle or are authorised to access it (for example your V5C logbook) together with photographic identification. We may refuse to carry out the work if we are not satisfied that you are entitled to the keys or access, and we accept no liability for any delay or refusal on this basis. Some vehicles have pre-existing lock, immobiliser or electronic faults that may only become apparent during key or entry work; we will discuss any such issues with you, but we are not responsible for pre-existing faults.
8. Insurance — your duty to notify your insurer
Remapping and other modifications can change your vehicle from its manufacturer’s specification. You are responsible for informing your motor insurer of any remap or modification we carry out. Failing to declare modifications may invalidate your insurance policy. We accept no liability for any loss arising from your failure to notify your insurer.
9. Manufacturer warranties
Modifying your vehicle’s ECU or software may affect, reduce or void any manufacturer’s or dealer’s warranty. It is your responsibility to check the terms of any warranty before proceeding. We are not responsible for the loss of, or any refusal of a claim under, a manufacturer’s or third-party warranty resulting from work we carry out at your request.
10. Emissions equipment, legality and off-road use
Certain modifications — including any that remove, disable or alter emissions-control equipment such as a diesel particulate filter (DPF), exhaust gas recirculation (EGR) system or AdBlue/SCR system — can make a vehicle illegal to use on public roads in the UK, can cause it to fail its MOT test, and may breach road-traffic and emissions legislation. Any such work is offered strictly for motorsport, off-road or export use only. Where you request this type of work, you confirm that the vehicle will not be used unlawfully on public roads, and you accept full responsibility for ensuring that your use of the vehicle complies with all applicable laws. We accept no liability for any fines, penalties, MOT failures or other consequences arising from your use of the vehicle.
11. Performance results
Any performance figures or gains we mention are estimates based on typical results and are not guaranteed. Actual results vary depending on the vehicle, its condition, fuel quality and other factors outside our control.
12. Risks of tuning and mechanical condition
Vehicle tuning increases the demands placed on an engine and its components. While we take reasonable care in all work we carry out, we cannot be responsible for the failure of components that were already worn, faulty or at the end of their service life, or for pre-existing faults that become apparent during or after the work. We may ask you to acknowledge these risks before we begin.
13. Our responsibility for loss or damage
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or of our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud. Subject to this, our total liability to you for any claim arising out of the work will not exceed the price you paid for that work, and we will not be liable for indirect or consequential losses. Nothing in these terms affects your statutory rights.
14. Faults, complaints and your statutory rights
As a consumer, you have rights under the Consumer Rights Act 2015, including that our services will be carried out with reasonable care and skill. If you are not happy with any work we have carried out, please contact us as soon as possible at info@southwalesautotech.com so that we have the opportunity to put things right.
15. Data protection
We handle your personal data in accordance with our Privacy Policy, which explains how we collect, use and protect your information.
16. Events outside our control
We are not responsible for any delay or failure to carry out the work that is caused by events outside our reasonable control, such as extreme weather, accidents, illness or supply failures. If such an event occurs, we will contact you to rearrange.
17. Governing law and jurisdiction
These terms are governed by the laws of England and Wales. Any disputes will be subject to the jurisdiction of the courts of England and Wales. If you are a consumer resident in Wales, you may also bring proceedings in your local courts.
